Occupy the green area of the park and raise ostrich for more than 10 years, and retire at the end of the year

The court forced the "placement" of 23 ostriches

This newspaper news (reporter Zhang Lei) occupies more than 6000,23 square meters in the green area of Changying Sports Park in Chaoyang District, raises 9 ostriches, and the site leaser has been "ripping off" for many years due to the problem of renting and vacating, and the court has also delayed the performance after the judgment. Recently, with the cooperation of multiple departments, the Chaoyang Court forcibly vacated the venue involved in the case, and after 23 hours, properly placed <> ostriches, wood, equipment and other items in the venue.

The executors, Mr. and Mrs. Zhu, are villagers in a village in Chaoyang District. In 1983, the couple registered a company, leased the collective land of the village to build a factory, produce doors and windows, and began to raise ostrich on the site in 1993. In 2005, according to the plan, the area where the site is located was used for the construction of a green separation belt, and the village economic cooperative negotiated with Mr. Zhu and his wife several times. In August 2009, the two parties signed the "Termination Agreement", stipulating that the original lease contract was terminated, and the village collective compensated the two companies for more than 8 million yuan, and Mr. Zhu was required to vacate and hand over the above-ground objects within two days from the signing of the agreement, and the compensation was paid in two installments after the experience was collected. However, Mr. Zhu did not hand over the venue as agreed. After the village economic cooperative filed a lawsuit, the court ordered the couple to vacate the site in accordance with the law.

When the village economic cooperative applied to the court for enforcement, the area where the venue involved in the case was located had been built into today's Changying Sports Park. Changying Sports Park has been loved by nearby residents since it was put into use, but the fly in the ointment is that the site involved has always occupied a corner of the park, which not only hinders the further optimization of the park's functional space, but also greatly affects the park experience due to the accumulation of debris and unpleasant smell brought by raising ostriches.

The enforcement judge repeatedly urged Mr. and Mrs. Zhu and their company to fulfill their obligation to vacate the site as soon as possible, delivered the venue, and posted a vacancy announcement on the scene ordering them to perform within a time limit, but the couple still did not perform. Recently, the Chaoyang Court joined hands with multiple departments to carry out forced vacation.

At the scene of the evacuation, the executive judge saw that there was no answer to the knock on the door, and instructed the bailiffs to climb over the wall and enter the courtyard to quickly check the situation of each house, and after confirming that there was no one in the venue, they forcibly demolished the gate. During the execution process, the judge contacted Mr. Zhu by phone and informed the couple of the circumstances that would be forcibly vacated that day, the location of the items, and the relevant rights and obligations, and asked him to rush back as soon as possible to confirm the handover. Mr. and Mrs. Zhu expressed their willingness to cooperate with the court in its enforcement work.

Immediately, the on-site notary began to count the items, and then the moving company packed them and numbered them out. Twenty-three ostriches were also transported to the resettlement site provided by the applicant executor. During the evacuation work, Mr. and Mrs. Zhu rushed to the scene and reconfirmed the items at the scene. After nine hours, the vacancy was completed and the court returned the site to the Village Economic Cooperative, the applicant for executor. (Beijing Daily)
